Jamiat Ulama-I-Hind has asked the Supreme Court against using bulldozers to level the homes of people suspected of being involved in crimes such as violence.
Jamiat Ulama-I-Hind has called on the Supreme Court to give proper direction to the Union of India and all nations that no lasting action be taken against any of the defendants in any of these cases. any criminal proceedings and give instructions not to demolish the home as a measure of punishment.
In a tweet, Jamiat Ulama-e-Hind President Arshad Madani, said, “Jamiat Ulama-e-Hind has filed a petition with the Supreme Court against the dangerous politics of bulldozers that have been started to destroy minorities especially Muslims under the guise of crime prevention in BJP-ruled states.”
Jamiat Ulama-I-Hind, in his petition, said there has been a recent increase in government demolitions of residential and commercial property in several states as a punitive measure against with those with intent to be involved in crimes such as riots.
“In response to alleged acts of violence, authorities in several states have used bulldozers to raze the homes of people suspected of being involved in such acts/incident. Several ministers and legislators, including the Minister and Minister of Home Affairs, of the state of Madhya Pradesh, have issued statements in favor of such actions and specifically threatened minorities with destruction. their homes and commercial properties in the event of a riot,” the petition reads.
According to the petition, the use of such measures/actions violates the features of the Constitution and the criminal justice system, as well as violates the rights of the accused.
“Such government measures undermine our country’s criminal justice system, including the important role of the courts. The legal process, including the pre-trial and adjudication stages, impeded by these acts of the state, therefore, immediate action is necessary to prevent such incidents from happening again,” the petitioner said, calling on the Supreme Court to step in. prevent further escalation and also prevent such behavior from being repeated in other states.
Jamiat Ulama-I-Hind sought guidelines that any commercial property cannot be destroyed as a punitive measure. It also asks the court to issue guidelines to provide training for police officers in handling communal riots and situations where people become resistant.
The petitioner also called for guidance that ministers, legislators and anyone not involved in criminal investigations should limit criminal prosecution in relation to public criminal action. or through any official communication until the criminal court makes it public or through any official communication until the Criminal court is determined.
