National HBPA Statement of FTC approval of HISA safety rules
Federal Trade Commission (FTC) approval of accreditation rules and standards including the Equestrian Safety Authority’s (HISA) Track Safety Program on Friday.
The national HBPA released the following statement on Saturday:
“The Federal Trade Commission (FTC) on Thursday, March 3, 2022, issued an order approving without exception all track safety regulations issued by the Safety and Integrity Authority. (HISA) released. Rubber stamping orders are accepted without all proposed rules as well as accepting the Authority’s response to comments submitted by industry participants .
The Order recognizes that many of the input from industry stakeholders are helpful and constructive for improving the rules. However, the FTC declined to dismiss any of the rules, nor did it direct such constructive changes to be included prior to approval. Instead, the FTC has taken the stance that it would welcome future proposed rule amendments that the Deciding Authority submits in response to comments received.
This FTC Order makes it clear that this private entity of self-appointed rulemakers (i.e. Authority) has unchecked power without government oversight to control the industry. horse breeding.
The illusion of government surveillance control was clearly dispelled with the FTC accepting all of the Agency’s proposals without exception. It also demonstrates that this private organization will make the rules without regard for the constructive comments of industry stakeholders.
The FTC’s order affirms the substantial concerns expressed in pending lawsuits that such authorization of control is unconstitutional and that the input of those closest to the equine industry is no longer available. suitable anymore. “
