Convicted veterinarian Seth Fishman was hospitalized for psychiatric reasons during his trial

Dr. Seth Fishman was absent from the Manhattan courthouse in the final days of his trial in relation to his role in the manufacture and distribution of performance-enhancing drugs, an absence not explained for many months. But a motion made Friday by attorney Maurice H. Sercarz asking for his sentencing to be postponed answered the question. Mermaid is expected to be sentenced on Monday. Mermaid was originally scheduled to be sentenced on May 5, but Sercarz was twice granted a postponement by the court. His latest request for a delay is the first time he’s raised the issue of Mermaid’s mental problems and the delay in completing a report that includes his health and emotional problems. he.
Sercarz’s profile paints a picture of a client who had battled mental health issues for years and was first admitted to the psychiatric ward at a New York hospital in 1996.
Following Sercarz’s motion, on February 18, Fishman was transferred to the custody of the United States Marshals and taken to the Metropolitan Detention Center (MDC), where he was quarantined for over a week and continue to be evaluated by mental health professionals. More time is needed for the doctors at MDC to work out a drug that can help ease his condition.
Fishman remained locked up at the MDC in the spring when Fishman and his family agreed to have a vet checked out for a psychological evaluation. Around April 22, a doctor identified as Dr Bardley was hired to conduct the assessment. This process was delayed because Fishman was unable to sign some paperwork due to sporadic lockdowns at MDC.
Bardley gave his first interview with Fishman on May 27. A follow-up appointment scheduled for June had to be canceled due to another lockdown at MDC. After many issues remained, Bardley was able to conduct a review with Fishman, who remains at MDC, on Thursday and submitted a draft of his report to Sercarz. Sercarz writes that sentencing should be delayed until Bardley and his staff have had a chance to complete and finalize their report.
Sercarz hopes that the filing of Bardley’s findings could lead to leniency in sentencing.
“While the defendant will seek leniency based on his or her mental health issues, we believe the public will have a satisfactory understanding of the nature of his or her condition. report and the manner in which it may affect the Court’s decision if any. was imposed based on descriptions of the defendant’s conditions,” the motion wrote.
The jury found Fishman, 50, guilty of two counts of conspiracy to violate the law of fraud and mislabelling and the manufacture of administered PEDS for racehorses. He faces 20 years in federal prison.
