Last week saw a flurry of developments and information drop as the countdown to July 1 – the official launch date of the Safety and Integrity Act (HISA) – continues.

In addition to providing a cheat sheet to help guide industry participants through the launch, TDN answered unanswered questions industry participants had about the application process and about the new playing field that will arrive on July 1, please forward them to HISA for answers.

“Starting July 1, 2022, horses will not be allowed to run in a race if the trainer has not registered the horse with HISA.”
Some of the following questions have been edited for brevity and clarity. If any submitted questions are not answered here, we will attempt to include them in the next batch.
Question: My question concerns horses on a ranch or breeding facility. While it seems unlikely that everyone working in one of these places will need to register as an insured, some of these people (such as farm managers and veterinarians) will have more responsibility for the prescribed medications and veterinary treatments provided to horses in their care.
I see that there are Important care and treatment records should be provided to HISA. And so, if certain people performing treatments and drugs on a farm or facility are not registered as “insured persons” under HISA, who will be ultimately responsible for them? what goes on there? The trainers? The owners?
HISA: You are right, most employees working on farms and livestock facilities are not required to register with HISA. Employees who are licensed with the State Racing Commission and work directly with insured horses are required to be registered with HISA. For example, if a veterinarian is licensed by the state racing commission and is treating a pony at a health care facility, he/she must be registered with HISA. .
The responsible person, usually the trainer, is to have and maintain all training and medication records for horses on farms, care facilities and training centers. In the event that the trainer is not the person responsible for the horse, the owner will be responsible for maintaining all records of exercise and medication treatment for the horse at the ranch and farrowing facility.
Q: According to the rules of playing jockey, in some cases of violation, the owner loses his wallet. I understand that it was only the wallet that was lost, while the horse remained in its place. If yes, where will the money in the wallet go?
Q: There are three types of offenses against the use of equine crops. Class 1 violations do not result in loss of wallet. If the crop violation is a Level 2 or Level 3 violation, the horse will be excluded from wallet earnings.
The HISA Track Safety Committee will provide guidance on how to use/allocate the funds in that wallet in the coming weeks.
Q: What if I’m confused by the new rules and I had to register, but I didn’t? What are the consequences? And who enforces them?

HISA is focused on getting as many people and horses registered as possible by July 1. This includes education, support and engagement with stakeholders across the industry to ensure everyone is informed. informed and well equipped to sign up as soon as possible.
Q: Once we register ourselves, with our physical address as one of the requirements, we will allow ‘Agency’ free access to our home/farm. Can you please explain specifically why?
Q: HISA will always exercise its powers in good faith and in the interest of sport. Our original regulation stated: “Authority”[s]The Hall shall have free access to the books, records, offices, racetrack facilities and other places of business of the Insured Persons used in the care, treatment, training, training and racing, and to the books, records, offices, premises, and other places of business of any person who owns a Covered Horse or performs services on a Covered Horse. ”
The FTC in approving the Code of Enforcement noted that commentators who opposed the rule were actually opposed to the Act because our rule follows the Act. Although the rule has been approved by the FTC, we have revised the rule and will send the revisions to the FTC in the next few days. The relevant rule now states:
(1) There will be free access to:
(i) in connection with the Insured Persons, books, records, offices, racing facilities and other places of business of the Insured Persons in connection with the care, treatment, training, train and race the Covered Horses, and
(ii) in relation to any person owning a Protected Horse or performing Covered Horse services, books, records, offices, premises and other places of business in connection with it. the care, treatment, training and racing of horses.
Even if the revised rules are not approved by the FTC by July 1, 2022, HISA will follow these parts of the revised regulations.
And finally, it’s important to note that the language used by Congress is not new. For example, current Kentucky law uses the same language as the original HISA regulation. It says:
“The Racing Commission, its representatives and employees, may visit, investigate and have free access to the offices, racetracks, premises or other places of business of any licensee. permit, or any person who owns a horse or performs services provided for by this chapter in respect of a horse, subscribes to a breeder’s incentive fund under the jurisdiction of the Equestrian Commission. ”
Q: Rule 8400 Section Authority of Investigation a) subsection 1). The rule also allows HISA to seize “drugs, drugs, infusion devices, or infringing or suspected ‘Authority’ violations, along with all your books and files.
In every state, any person who is not a veterinarian can carry needles and syringes on the track. If correct, this makes absolutely no sense, so could you please provide the reasoning behind this?
Q: The HISA needle and syringe regulations apply to Covered Racecourses and Covered Training Facilities. These regulations do not apply to farms.
Q: Under the revised “Authority” rules (not yet submitted to the FTC), holidays and weekends are no longer “working days” and will not be considered “countable” days. “. Q: This is not correct. The new time calculation rules only cover the response dates specified in the Enforcement Rules.
For example, it is clear that if an individual is given a certain number of days to file an appeal or file a summary and that date falls on a holiday or weekend, the deadline is the next business day. . The time rule calculation in the Enforcement Rules has nothing to do with the number of days someone serves for the suspension.
Additionally, this timing method helps riders by giving them extra days to meet and not requiring them to count weekends as race days.
Q: I read the question and answer for someone who needs to apply that says someone who works regularly in a stable area. Others who have access but do not work in the barn in the course of their normal work do not have to register. Access to the barn is still controlled by state commission licensing. This makes it clear except their website says the exact opposite. Their website says any employee with access to the barn must be registered. Could you please try to clarify the nothing?
Q: This language has been updated on the HISA website. Just to be clear: you must register as an Insured if you are licensed by the State Racing Commission, unless you have no contact with Insured Horses and you do not have access to the riding areas. restricted area of the track during the normal performance of his duties.
