Judge amends, but does not cancel, mermaid’s bail condition

After federal prosecutors allege that veterinarian Seth Fishman allegedly was still selling purported performance enhancing drugs (PEDs) pending trial in the international doping conspiracy case, the judge in The case on Wednesday ordered an amendment to the new bail conditions after hearings on both sides of the matter. at Monday’s hearing which could – but did not – result in Fishman’s bail being revoked.
Judge Mary Kay Vyskocil of the United States District Court (Southern District of New York) wrote in a December 22 order that the following additional provisions would apply to Fishman’s pre-trial release: :
“The defendant shall surrender all drugs and/or substances currently stored at [the address for his Boca Raton business] to an agent of the Federal Bureau of Investigation, Food and Drug Administration, or FBI or FDA designee, within two weeks of December 20. Anytime before surrendering drugs or other substance… the defendant , his agents and any employees of any business controlled by the respondent will not be admitted [Boca Raton business]. During the period of pre-trial release, the respondent, and all organizations he controls, shall not manufacture and/or distribute any drugs or narcotics nor may use any drug or substance, with the exception of drugs and substances that the defendant may self-administer in the self-treatment of his or her medical conditions. ”
Fishman was charged with two counts of drug modification, misbranding and conspiracy to defraud the government. His path is expected to begin in January.
On December 6, federal prosecutors asked the judge overseeing the case to consider rescinding the bail provisions for Fishman’s pre-trial release. The basis for that claim was that a Fishman employee informed the government that Fishman was still believed to be creating pharmaceuticals for overseas distribution and an FBI search of Fishman’s business. authorized by that employee allegedly discovered several of the same drugs that formed the basis of some of Fishman’s initial charges.
A week later, Fishman’s legal team denied the allegation while alleging that the union’s move to recover Fishman’s bail was a plot to sabotage his legal preparations for the upcoming trial. .
