A federal court sided with the medical groups in 2019, forcing the FDA to begin enforcing the licensing process for e-cigarette companies. The FDA has given e-cigarette manufacturers a 2020 deadline to apply for a license or be forced off store shelves. (That deadline was later pushed back, because of Covid.) Juul is now available to rotate. Finally, in June of this year, the FDA went to Juul, denied its own marketing application, and placed its product on the market. Even when Juul exists, its moment as a breakout market leader may have passed. Instead of giving up the vaping habit, his friends turned to other brands that emerged to capture Juul’s dwindling market share. The FDA ban applies to flavored vape cartridges, like Juul pods, but not disposable, pre-filled and prefilled e-cigarettes.
