The Supreme Court on Monday watched a Bollywood film ‘Munna Bhai MBBS’ while it was dealing with a case that revoked the admission of more students to a medical college, due to an unscheduled examination with the reason that patients are in the “hard and hearty” areas and “no serious inpatients are found in the pediatric ward”.
The National Health Commission (NMC) told the highest court that the admission of more students was canceled because there was no operating factory and no X-RAY machines on campus in addition to the defects. is different.
A bench of Judges DY Chandrachud and Surya Kant said, “It was shocking. It’s like a Munna Bhai movie. All patients in the ward were found to be cheerful and hearty. There were no serious pediatric patients in the pediatric ward. We cannot know what else we found in the inspection report. We are very surprised.”
Senior campaigner Abhishek Manu Singhvi, representing Annasaheb Chudaman Patil Memorial Medical College, said that the check was done by the NMC without any notice and also on a public holiday i.e. festival ‘Makar Sankranti’, which is Prohibited.

The board is hearing the appeals filed by NMC and the medical college, located in the Dhule district of Maharashtra, against the order of the Bombay High Court, which directed the commission to examine the new university and allow admission student.
Solicitor General Tushar Mehta and defense advocate for Gaurav Sharma said that the NMC can take a surprise test under the law and what the Supreme Court order did was allow 100 MBBS students, to be admitted “in this type of school this university”, that is the original capacity.
“There is no operating theater and no X-Ray machine,” Mehta said, adding that students need not worry as they will be accommodated in other colleges after consultation. of the government.
Mehta said, “Only one thing I need to point out, 100 is licensed and 50 is new and what this order does is they go ahead with 100 but don’t admit new so the new batch doesn’t come in the Organization category. . Now, if we revoke their accreditation, those students will not be affected, because in consultation with the government we will distribute them in other colleges. But now they can’t start adding new students to this type of academy.”
Singhvi says that this college has been operating since 1992 with a capacity of 100 MBBS and hence NMC has no right to revoke admission permits for these places.
He said that the NMC did not allow the addition of 50 seats based on the inspection report.
Senior advocate Nidesh Gupta, who also appeared for the university, said that the infrastructure that was flagged by the NMC in the inspection report had existed for decades, and there were no problems with it after that. .
The bench overturned the order of the Aurangabad bench of the Bombay High Court and asked the court to reconsider saying that “The Supreme Court did not handle the argument of the rival dispute, we have dropped the order Supreme Court embargo of January 25, 2022. and February 2, 2022, and restoration of admission before the Supreme Court”.
“As the record before this court stands, both the NMC as well as the medical college, are affected by the Supreme Court order,” said the bench man. A decision based on an overall shortfall that has been noted during a surprise inspection cannot be justified by simply ordering a new test without questioning the validity of the test already performed”.
It notes that the medical college, established in 1992, has a capacity of 100 seats for the MBBS course.
“The medical college submitted an application on November 30, 2020 to increase its enrollment capacity from 100 to 150 MBBS for the 2021-22 academic year. Until July 15, 2021, the accreditation will be extended for the 2021-22 school year with the condition that the recognition continues in accordance with the law,” he noted.
“NMC-appointed assessors conducted a physical inspection on September 8, 2021, and the certificate of intent was issued on November 16, 2021. The college submitted the pledge on November 23, 2021, then November 25, 2021; has been licensed to increase the capacity from 100 to 150 seats”, it said.
The Supreme Court noted that on January 14, 2022, an unscheduled inspection was conducted, and based on the inspection report, on January 19, 2022, the NMC withdrew its letter to allowed to increase the receiving capacity and directed to stop enrollment in 2021-2022.
The Supreme Court order was challenged by the NMC in the highest court on the basis that it was passed without regard to the provisions of the NMC Act. The medical college also challenged the Supreme Court’s order.
